this is fox 5 news at 10:00. >> tonight on fox 5, judgment day for jerry sandusky. the convicted child molester learns his fate. >> plus, d.c. hours away from hosting its first playoff baseball game since 1933. the nats getting ready for a

pivotal game. and more than 100 organizations go together. how the transit agency is responding. >> we are going to start off with jerry sandusky's sentencing, three months after he was convicted of 45 counts of child sex abuse. the former penn state football coach learned he will likely die in prison after a judge sentenced him to 30 years behind bars. will thomas starts us off with his fate. >> you know, he knows he lost his freedom and essentially got a life sentence given his age. we don't know yet where sandusky will serve his time. it's going to be evaluated and tested and moved to his new permanent home behind bars. as you'll see after the convictions, all the victims that came forward, sandusky still says he lost in court to speck youlation. >> convicted pedophile, jerry sandusky, left the courthouse facing the next three decades behind bars. the 68-year-old will do at least 30 years in prison.

>> obviously it's still a life sentence, but it was less than we thought it could have been. we are busy drafting our appeals right now. >> jerry never flinched from his position that he was innocent and that he wanted the opportunity to prove his innocence. >> sandusky is speaking before the sentence, once again denied any wrong doing. and ahead of his sentencing, he read an audio statement from his jail cell. >> they can take away my life. they can make me out as a monster. they can treat me as a monster. they can't take away my heart. in my heart, i know i did not do these alleged, disgusting acts. >> the prosecution has no sympathy for sandusky, calling his statements masterpieces of self-delusion. >> completely untethered from reality. without any acceptance of reality. in short, ridiculous. >> several victimgave impact statements during sentencing. they described how the

traumatic experience changed them. some of the attacks happened inside the penn state facilities. the university president released a statement after the sentence. saying quote, while today's sentence cannot erase what has happened, hopefully, it will provide comfort to those affected by these horrible events. >> at least four young men are now suing penn state over the way the university responded to complaints about sandusky. and we're told more lawsuits are on the way. the school recently announced an effort to settle as many claims as possible by the end of the year. so shawn, this one not over yet. >> will thomas, thank you. another big story tonight, a monumental moment in the nation's capital. tomorrow, d.c. hosts its first playoff game in 79 years. fox 5's scott myth is here. is this a pivotal game for the nationals? >> it's fair to say that. it's been 79 years almost to the day. october 7, 1933, it was a 4-3

world series loss to the new york giants. let's hope a different result tomorrow in game three against the cardinals. the best of five series split at one a piece. the team was back at nats park coming off monday's eight route run in los angeles. jason worth and the guys staying loose. they needing to shift that momentum back in that direction. it's an important one tomorrow and they are happy it's in front of the home fans. >> we feel comfortable being at home. we put ourselves in a good position to come home and win a series. if we can do that like we've done a lot of times this year, then we'll be sitting pretty. >> our fan base, all yearlong has been outstanding. they have been into the games as good as any fans i have been around. you know, we got rid of the philly fans, started taking up more space themselves. so it's been great. the guys really enjoyed playing here. we love the city.

if you are riding the rails to the game, metro has advice. avoid switching lines near downtown. so, stay away from metro center, gallery place if you can. might want to take the new jersey avenue entrance to the navy yard ball park station because it gets less crowded and make sure you have your fare card to avoid long lines at the vending machines. new tonight, metro is stuck in the middle of the controversy over politically charged advertisements now appearing in several metro stations. the ads have appeared at subway stations in san francisco and in new york city. as fox 5 tells us, opponents are now asking for equal time. >> the poster in question is behind glass on the platform here at the u street metro station. also on display at takoma park, georgia avenue, and glennmonte. >> i know nothing about it, but i read enough to learn about it. >> the message reads, in any war between the civilized man and the savage support the

promoting mutual understanding, perhaps through another ad campaign that would counter the hate message in this campaign. >> metro officials don't give away ad space anywhere, but if care or any other group wants to counter this message with one of their own and a space becomes available, they are free to do it. they have to pay for the ad. >> and where in my message does it say muslim? >> but cares hooper says it is certainly implied. >> if she wants to spew hatred, she is free to do so in america, but it's up to the rest of the society, the mainstream practitioners to come together to repudiate hatred and promote mutual understanding. >> those posters did not go public without a fight. metro wanted to hold off, but the ads had to go up now. it was concerned about public safety and adding fuel to the

fires burning recently. so far, reaction here has been muted. brian. >> bob tonight. another big story we are following this everyoning. former d.c. chair has an overnight curfew. a judge lashed out at brown for missing three court appointed pretrial phone check ins. fox 5's matt acklin has the story. >> former chairman of the council, kwame brown, was greeted by reporters and photographers as he walked into the federal courthouse and once again, as he left, brown seemed surprised by all of the attention. >> did you say anything? >> all these reporters are here. that's pretty disturbing. >> it was judge richard leon who seemed most disturbed. leon wanted to know why his presentencing orders were not being followed. what do you have to say about your conduct, he asked? brown apologized for wasting the court's time because he said he knew the importance of

calling in. but when brown offered reasons why he didn't think he was violating the rules, leon continued to scold him. then ordered brown to check in with court officials in person each week. no longer by phone, and then added an overnight home curfew from 11:00 p.m. until 6:30 in the morning. >> that's all i could say. >> few words outside court from brown's attorney, fred cook. brown is just about a month away from being sentenced for bank fraud. and cook thinks his client now understands what to do before then. >> i think, you know, he has a clear understanding of what is in front of him. you know, so he's going to do what he needs to do. >> it's not the best idea to upset judge leon. he will be the one that sentences brown next month. he told brown in court today that he didn't want to see him back in front of him until that

a medical examiner says sarah greenhall was shot in the neck back in july. her body found in her burning home in upperville. so far, no arrests in her death. greenhall worked for the winchester star. a prince georges county sheriff deputy facing a $15 million lawsuit. he was accused of raping an inmate last summer. now the woman's lawyer says the deputy took pictures of her naked inside a holding cell. fox 5's paul wagner has the story. >> on june 19 of this year, precious reaves was locked up on a theft charge and scheduled to go before a judge in this upper marlboro courthouse. but according to police, she was escorted to a holding cell where she was ordered to disrobe by uniformed deputy. although fox 5 does not identify sex assault victims, reaves, through her attorney, decided ed to go public. the deputy took breaks during the assault to attend to his job. >> his walkie talkie went off.

he said stay naked, i'll be right back. goes outside the cell, comes back, and begins to have sex with her again. >> his client felt she had no choice but do what the deputy said. >> she didn't see other guards. all she heard was someone calling on the radio. he told her not to put her clothes back on and he would be back. she didn't see any of the guards. >> the deputy was armed with a handgun when he escorted reaves into the holding cell, which was out of site for courthouse surveillance cameras. >> he started making comments towards her, about her abilities, things you would hear in a rated x movie. >> online court records show reaves remained locked up. deputy mcintyre was released on a $50,000 bond. mcintyre is facing a child on rape and sexual assault

charges. as for the civil lawsuit, the deputy is named as a defendant as well as the state of maryland. as for precious reaves, she wanted to go public in hopes of helping other sex assault victims. in the fox 5 newsroom, i'm paul wagner. tsa agents found a loaded gun at reagan national airport and tonight, the passenger is facing charges. agents spotted this handgun. the airport authority took the gun, charged the man with a misdemeanor weapons charge. the passenger was allowed to continue on to a flight to dallas. >> what do you do if you are riding a school bus and your driver passes out. happened to some clarksburg high school students. thanks to quick thinking, one of the students, everybody is okay. after the driver lost control of the bus. fox 5's karen gray houston has the story. >> high school students take the bus to school early. it was about 6:40 a.m. friday when 17-year-old, dustin

mitchem was on a bus and got a frightening jolt. he had been listening to music on his ipod. several other students had just good night on the bus. >> bus driver stopped abruptly and his head slumped down. >> they had been traveling when the bus driver had some kind of medical emergency. dustin rushed up front and tried to shake the driver awake. >> then, i picked up the bus radio and i radioed to them, you know, saying my bus driver blacked out, we need help. >> you can still see the bus tire tracks on the front lawn where the bus came to a halt. >> i got up and looked out my window. i saw a bus and flashing lights coming from everywhere. >> what were you thinking was happening? >> i thought the bus had a flat tire. >> saw the whole thing. >> came 10, 15 feet from hitting a pole. >> principal says the school is proud of how the students handled the emergency.

dustin's parents are gushing with pride. >> we have no idea. as the bus was probably rolling towards the spot here, forward to the bus driver. >> i'm so proud of him. i'm so proud of the way he handled himself and he did, i know my husband didn't mention this, but he did call mom and tell me what was going on. >> dustin is a take charge kind of a guy who knows how to step up in a crisis. he says when he graduates from clarksburg high here, he's going to go to trade school and become an electrician. in montgomery county, karen gray houston, fox 5 news. dustin's family expressed concern about the health of the bus driver, but school officials have not released any information about his condition. most of us know how to handle d.c. traffic circles, that guy does not. he decided not to drive around

compounding pharmacy, which custom makes medicines using more than one drug. we are following another story, the taliban is claiming responsibility for what many are calling a heinous crime. the shooting of a 14-year-old girl in pakistan. she was an activist for girl's education and other freedoms squashed by the taliban. jane reports. >> the taliban attacking a teen activist in pakistan. 14-year-old was shot twice by a gunman on a bus that was taking children home from school. >> an unknown gunman approached the school bus and asked. students told him that she is mulala and without having a conversation, he opened fire, hitting her forehead. >> she was air lifted to a military hospital after being shot in the head and neck. amazingly, she survived, but doctors are saying the next few days are critical. another girl was shot on the bus, but she's in stable condition. taliban claims responsibility for the shooting saying quote,

this is fox 5 news at 10:00. >> tonight, a major poll says mitt romney pulled into the lead in the race for the white house. after a strong debate performance last week, a week of high profile events, romney is beating president obama by four points in the poll. fox 5's tom fitzgerald talked to the people who put it all together and has details. >> for mitt romney, the post debate bounce is stretching into its second week. >> that was a good debate. i enjoyed that debate. >> while president obama is looking to get back on track

numbers, brian. among women, he was up, the president was, by 18 points. now they are running even now. among people who are 50 and younger, a group very much favorable to president obama, a short time ago, president was up 17 points in that category and it's now even. and then among independents, he is losing too. so these are dramatic reversals for president obama from constituencies that were very much in his camp. >> romney saw a bump in every swing state, but why spending so much time in ohio these days? >> ohio, the mother of presidents. eight presidents from ohio. you're going to hear this ad and i add to it, no republican has ever been elected without winning ohio. the president was up by as much as 9. in one poll as much as 12 points. the president has had 17

rallies. he spent more time in ohio than any other state. romney almost last week, brian, was writing ohio off. now they are spending four of the five days this week in ohio and he needs an inside strength. ohio, florida, and virginia, and then one other state, nevada, colorado, or iowa. but even with those long odds, which is described as an inside scrape, the president's camp is definitely nervous. >> let's talk about the upcoming vp debate this thursday. what is biden and perhaps ryan have to accomplish here? >> biden has to change the whole talk. the whole momentum. he has to come back and he's got to win the debate. paul ryan has never been on the national stage. paul ryan had served on the budget committee with chris. neighbor in congressman and that is who is going to play

the stand in. ted olsen, the former solicitor general played biden to ryan. but biden has to come through. he has to elevate the spirits of the obama campaign. so it's very critical that he does well and changes the conversation. >> i think even the most die hard democrats are thinking, oh no. it all rests on biden right now. >> they don't want anymore gas and they want them to hold things for the president to come back in the final two debates. >> all right, fox 5 political analyst tonight. >> thank you. and of course, you know, vice president joe biden and paul ryan will go head to head thursday, but they are not the only ones looking for a debate related boost. all of danville, kentucky, is hoping to benefit. streets have been repaved. flowers planted, even stores are stocking up on merchandise.

siberian cub. critics wonder, just like alligator attractions that came under fire for their swim parties, are big cats and kids an appropriate pairing? >> with an animal, there's always a risk. you are in there with at least one of the trainers in the water with you. >> president and head trainer, randy stern, says tigers are natural swimmers with webbing between their toes. there are no laws regulating swimming with tigers. >> they are very strong, but also very well trained. that's why a lot of those don't let you interact because they don't have the staff or knowledge to do it. >> to his knowledge, he has the only place in the u.s. you can do this. >> tigers by state law, like tony here, can be with the public until they are 40- pounds. >> that's with a leash. state law says it's okay for big cats 25-pounds or less to be handled with only a trainer's restraint. a trainer must be present.
